Rental Agreement Policy
This Rental Agreement (“Agreement”) is entered into by and between DORM WISE LLC (“Owner”) and the individual or entity (“Renter”) renting property from the Owner for the purposes outlined below.
In consideration of the mutual understandings and agreements set forth herein, the parties hereby agree that Owner will rent the property described herein to Renter, subject to the following terms and conditions:
1. Description of Rented Items
Owner does hereby rent to Renter the following items (herein the “Rented Items”): The Dorm Bed Cubby is a bedside shelving unit for lofted beds with three cubby spaces. Without extenders, the unit is 80” wide, 71” tall, and 6” deep (with the top ledge being 6.5” deep). Extenders are separate and raise the cubby 16” – to a total height of 87” (other dimensions are the same).

3. Delivery & Pick Up
UNCW will provide Owner with a designated delivery day for the Rented Items – delivery day will be before FALL move-in. UNCW will provide Owner with a designated pick-up day for the Rented Items – pick-up day will be after the last day of SPRING classes. If renting only for the Fall Semester, Renter is to contact Owner by December 1st to set up a day/time to pick up the Rented Items.
4. Payment
The Renter agrees to pay the rental fees plus any applicable taxes/credit card fees. Rental Fees for the Full Year rental are $385 plus applicable taxes/credit card fees. Rental Fees for either the Fall Semester or Spring Semester are $270 plus applicable taxes/credit card fees. Extenders are $45 for the Full Year and $30 for either the Fall or Spring Semester (plus applicable taxes/credit card fees). Payment is due in full at the time of rental order.
5. Use of Rented Items
Renter agrees to use the Rented Items responsibly and strictly for their intended purposes. Although the Dorm Bed Cubby stands freely, it needs to be placed (and remain for the entire length of contract period) in between the wall and the dorm bed for support. Owner will install the Rented Items in the Renter’s dorm. Renter shall not move, re-position, or re-locate the Rented Items from their installed location. Any misuse resulting in damage or loss will be the responsibility of the Renter. There are three cubby spaces in each cubby. The maximum weight for each cubby space is 15 pounds. The maximum weight for the top shelf is 15 pounds. The combined maximum weight is 50 pounds though for whole cubby at one time. No items shall be placed, kept, or stored upon the Rented Items that exceed these maximum pounds. Exceeding this limit can result in a failure of the Rented Items which may result in serious injury or death. The Rented Items should never be used as a step-stool, or to support full body weight. Furniture tip-over, resulting in bodily injury or death, can occur in the event that the Rented Items are not used for their intended purpose, or in the event that the Rented Items are not properly positioned between the dorm wall and the dorm bed for support.
By entering into this Agreement the Renter assumes all risk of injury and property damage resulting from misuse of the Rented Items.
6. Maintenance and Repairs
The Renter must immediately notify the Owner of any necessary repairs or issues during the rental period. Repairs due to normal wear and tear are the responsibility of the Owner. Repairs due to negligence or improper use are the responsibility of the Renter.
7. Indemnification
Renter shall indemnify, defend, and hold harmless Owner, and Owner’s members, officers, and agents from and against any and all claims, actions, suits, damages, costs, losses, liabilities, judgments and expenses (including attorney’s fees and court costs) in connection with personal injury, property damage or any other matter arising out of or in connection with the possession, use, or operation of the Rented Items.
8. Relocation of Rented Items
Renter shall immediately notify Owner in the event that the Rented Items need to be relocated to a different dorm room. The relocation and reinstallation of the Rented Items must be undertaken by the Owner.
9. Cancellation Policy
Cancellations must be made by June 20th prior to the Fall Semester for a full refund (minus credit card fees). Late cancellations will result in a fee of $75.
10. Condition of Rented Items Upon Return
All Rented Items must be returned in the same condition as provided, clean and undamaged, at the end of the rental period.
11. Governing Law
This Agreement shall be governed by the laws of North Carolina, USA. Any disputes arising from this Agreement will be settled according to these laws.
12. Breach
Owner reserves the right to terminate this Agreement in the event that Renter violates any of the terms set forth herein, and said violation is not cured by Renter within five (5) days of receipt of written notice. Upon termination of this Agreement, Owner shall be entitled to remove the Rented Items from the Renter’s dorm.
13. No Subletting or Assignment
The Rented Items shall at all times remain the property of the Owner and shall not be rented or sublet by Renter, nor shall Renter assign or transfer any interest in this Rental Agreement without the written consent of Owner.
14. Persons Under Age Eighteen
This Agreement must be executed by the parent or legal guardian of any person who is under the age of eighteen.
15. Severability
If any term of this Agreement is to any extent invalid, illegal, or incapable of being enforced, such term shall be excluded to the extent of such invalidity, illegality, or unenforceability; all other terms hereof shall remain in full force and effect.
16. Agreement
This Agreement contains the entire agreement of the parties and there are no representations, inducements or other provisions other than those expressed in writing.
By completing the rental process, the Renter acknowledges that they have read, understood, and agreed to abide by the terms outlined in this Rental Agreement.
